COBRA Insurance: A Program to the Employed Once

Group health insurance is an insurance benefit of the workers granted by the employers as incentives. Health insurance can cover the medical costs including dental and physician fee. However, variation in privileges is present and this is dependent to the insurance policies that the employers have purchased from an insurance company.

In the United States certain provisions and mandates are created by the US government as benefits and privileges for the citizens’ welfare. COBRA stands for Consolidated Omnibus Budget Reconciliation Act of 1985. It is a law submitted by the US Congress that helps in the creation of an insurance program. The program specifies the continuous health insurance coverage grant to employees that have lost or left an employment. This means that employees and their dependents still have the right to continue paying for the health insurance coverage. However, the coverage can be obtained in specific conditions.

Qualifying events are stipulated in the statute specifying the instances in which the workers and their dependents lose their eligibility for the coverage. Among these are: covered employee’s death; termination of employment and other employment-related events such as lay off, strike, resignation, discharge and medical leave; divorce; and dependent child that has reached the age in which he is not anymore covered. The enumerated qualifying events are some of the conditions in which the law can still allow the workers and their dependents to maintain their health care plan that they have lost because one of those events have occurred.

COBRA insurance is available to the private sector as well as organizations sponsored by state and the local governments. Yet, COBRA health insurance plans are not applied to certain religious and other church-related organizations and those sponsored by the Federal government.

COBRA Insurance comes in group health plans that are availed by private sector employers that have at least twenty workers in the prior year. The health plans are generally welfare benefit plans that are governed by Employee Retirement Income Security Act or ERISA. The welfare benefit plans are subject to ERISA’ s requirements in the disclosure and reporting, fiduciary enforcement and standards. ERISA, however, does not establish the standard nor has the right to make decisions on the participant’s qualifications and eligibility. It only requires certain rules outlining the terms and qualifications of workers to be entitled to benefits.

A group health plan of COBRA insurance grants medical benefits to employees and their dependents that are covered by COBRA insurance through the sponsorship of the employers. They can get the plan through insurance. COBRA beneficiaries could avail of the medical benefits that are provided by the plan’s terms. The medical benefits may include: physician care; prescription drugs; surgery and other medical procedures, hospital care; and other benefits such as vision and dental care.

Health insurance plan is only offered by COBRA insurance. Life insurance is not integrated and covered under COBRA.

COBRA insurance premium is expensive because all of the costs of the health plan are now paid by the individuals. Unlike before when a portion of the health plan premium is compensated by the employers, the individuals, employees and their dependents can have a disadvantage of paying all costs including two percent administrative charge. However, there are options to minimize the premium. These may be dependent as to the preference of the employees.
